A moment of indiscretion can lead to a DUI in Georgia. Much like many other states, DUI laws in Georgia include many stiff penalties, including fines and jail time.
It is important to understand what you are up against after a DUI arrest. Here are a few possible penalties to keep in mind.
First offense
While first offenses are the least serious, they still result in significant penalties. Fines range from $300 to a maximum of $1,000. As for jail terms, those convicted may serve up to one year. License suspension periods range up to one year, with a $210 to reinstate one’s license. Those convicted must also serve 40 hours of mandatory community service.
Second offense
Keep in mind that subsequent offenses must occur within five years after the previous offense to incur elevated penalties. Under these circumstances, a second offense means a minimum jail term of 48 hours. The person may also receive a term ranging from 90 days to one year. When it comes to fines, the minimum is $600 while the maximum is $1,000. There is also a minimum of 30 hours community service and a license suspension period of three years. Second offenses also include a clinical assessment to determine the need for substance abuse treatment.
Third offense
People convicted of a third DUI offense face a mandatory minimum of 15 days in jail. The minimum fine is $1,000, with a maximum of $5,000. The license revocation period lasts five years, with a mandatory minimum of 30 days of community service. The person convicted must also return their license plate to the Department of Motor Vehicle Safety according to habitual violator status. Like second offenses, the offender must also complete a clinical assessment.
There are numerous legal consequences associated with DUI. However, law enforcement must still respect your rights and conduct themselves appropriately during the arrest.
